Duke Energy has communicated that they will be accessing some Blue Ash residents’ properties as they investigate route options in response to the significant public input surrounding the pipeline project.  As stated in their letter, they will be entering the properties so that Duke, the design firm, or the routing consultant can “conduct field studies, such as land surveys, soil tests, soundings, and other appraisals.”

It has been determined by Blue Ash legal counsel that Duke does, indeed, have the right to enter property for the purpose of studying/surveying the proposed gas pipeline. The authority has been given to Duke via the precedent set in recent case law as well as the State law.

The City does not have the authority to remove the surveyors from private property.
